Introduction

Welcome to the ManageHub website. This Privacy Policy outlines the types of personal information we receive and collect when you use our services, as well as some of the steps we take to safeguard information.

We collect personal information from you when you voluntarily submit that information to our website, this information includes: your name, email address, postal address, phone number, etc.

Use of Personal Information

The personal information we collect is used for providing our services and communicating with you. We do not sell, rent or provide your personal information to third parties.

Our website uses "cookies" to help personalize your online experience. You have the ability to accept or decline cookies using your web browser settings.

Information Security

The ManageHub website is hosted by Wix.com. We rely the Wix infrastructure to secure information you provide on their computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. Upon the purchase of a paid subscription (Program), TSWB Strategies Inc. (ManageHub, Licensor) hereby grants to you, an individual (Licensee) the revocable, personal, non-exclusive, and non-transferable right to:

Access and use the ManageHub Strategy book, LEAN-Team Building Game book, Manage Hub Meeting book, videos, Bootcamp content, tools, worksheets, software, and other resources (the "Methods");

and/or
Access and use online or in-person, individual or group support sessions, Roundtables, training workshops, and other live or recorded sessions (the "Services");

for the benefit of one organization only (the "Organization").

By accessing any of ManageHub Methods you agree not to use them for a business purpose without a Program.

The rights and obligations of this Agreement are personal rights granted to the Licensee and one Organization only. Sharing ManageHub Methods or Services with any other person not associated with your organization, or allowing other individuals, even those associated with your Organization, to view, or access the contents of ManageHub Methods (for example Bootcamp videos) or Services (for example Support Sessions) using your user name and password are in violation of this license when not specifically part of multi-user paid subscription (the "Program").

You may not make the ManageHub Methods or Services available on a network, or in any way provide access to the Methods or Services to multiple users, unless you have first purchased the appropriate multi-user licensed subscription Program from ManageHub.

The ManageHub Methods and Services are owned by ManageHub and are protected by copyright law and international copyright treaties. You may not remove or conceal any proprietary notices, labels, or marks from the Methods or Services.

Restrictions on Use

In addition to the above, you may not, and you may not permit others to:

De-compile, reverse-engineer, decode, decrypt, disassemble, or in any way derive source code from the Managehub Methods or Services;
Modify, distribute, or create derivative works of the ManageHub Methods or Services;
Copy, distribute, publicly display, transmit, sell, rent, lease, or otherwise commercially exploit the ManageHub Methods or Services;
Perform any coaching or consulting services using the ManageHub Methods or Services even if derivative works without a separate license agreement with ManageHub.

If any of the above Restrictions of Use provisions 1 through 4 are violated by Licensee or Organization, the Licensee and Organization agree to compensate ManageHub at a rate of 2.5 times the retail sales value of the products used and/or services provided by or used by the Licensee, Organization, or any third party.

Furthermore, Licensee and Organization agrees to provide copies of all derivative works to ManageHub in Microsoft WORD or EXCEL format. Furthermore, Licensee and Organization agrees that derivative works will become and remain the exclusive property of ManageHub; provided that the Organization will have the right to use the derivative works in connection with their Organization, so long as they clearly indicate that the derviative works are based on the ManageHub system, that ManageHub reserves any and all copyrights, appropriately refer to ManageHub trademarks or service marks, and include ManageHub’s complete contact information. In any case, Organization and Licensee will not have the right to disclose any derivative works to any third party or to use them for any purpose, except as specifically provided in this Agreement. Furthermore, Organization and Licensee, on ManageHub’s request, will execute and deliver such legal documents as may be necessary or appropriate to formally assign to ManageHub any and all rights Organization and Licensee may have to the derivative works.

Term

This Agreement is effective until terminated. You may terminate at any time by canceling your subscription using your ManageHub User Portal (https://www.managehub.pro). Your License and this Agreement also terminates if the monthly payment is not received within 10 days of its monthly anniversary day. Your License and this Agreement also terminate if you or your Organization fail to comply with any term or condition of this Agreement.

Upon such termination, you, the Licensee, and Organization agree to discontinue using and destroy all copies of ManageHub Methods or derivative works (for example, customized versions of any ManageHub Strategy's worksheets) in your possession, together with all copies thereof.

Refund Policy

ManageHub strives to offer the best possible methods and services. However, we want to make our customers aware of our financial policies. All sales are final. Once the payment is made, it is non-refundable. Your access to the ManageHub Methods and/or Services will continue to be available to you until the end of your current billing cycle. No exceptions are offered to this policy.

No Other Warranties

ManageHub Methods and Services are advisory. You and Organization bear the sole responsibility for the use and implementation of these Methods and Services in your Organization. You agree to forever indemnify and hold harmless ManageHub, your ManageHub Pro, its officers, directors, consultants, agents, sponsors, strategic partners, members, or persons acting in concert with any of the foregoing (the "Advisors") from and against any loss, cost, or expense resulting from your activities related to your use of ManageHub Methods and/or Services provided by ManageHub or Advisors.
While ManageHub and/or your ManageHub Advisor(s) may provide you with guidance, direction, and program materials, such a role is advisory and not of doing the activity itself. You will be solely accountable for producing the results during the program. In this way, ManageHub and/or your Advisor(s) seeks to educate, train, and motivate you in order to enhance your ability to run a successful organization.
You acknowledge that ManageHub and Advisors have not made any warranty of success or of any particular outcome and that neither ManageHub or Advisors are practicing law, accounting, or any other licensed profession.
You acknowledge that ManageHub’s and Advisors only obligation under this Agreement is to provide related advisory, not specific solutions to problems or issues of you or the Organization. Furthermore, you acknowledge that ManageHub Methods and Services are not exclusive of other methodologies or approaches, and this Agreement does not preclude you from researching, evaluating, and/or utilizing materials, products, or services offered by others in the area of business optimization, and other areas related to you and your Organization. Moreover, ManageHub and Advisors encourages your evaluation and use, in your judgment and discretion, of such other resources.
You acknowledge that it is your and Organization's obligation, not ManageHub’s or Advisors to apply the ManageHub Methods or Services to any specific problem or situation, regardless of whether ManageHub or Advisors discusses any such specific problem or situation with you or performs project management services. ManageHub Methods and Services are not a substitute for hands-on, intense management consulting. ManageHub consultants are available, for an additional fee and pursuant to a separate written agreement, to provide intense, hands-on business consulting services (prices vary depending on the nature of Organization and its issues). Other than as expressly provided in this Agreement, the ManageHub Methods and Services are provided “as is.”

NEITHER MANAGEHUB, ADVISORS, NOR ANY MANAGEHUB RELATED PARTY GIVES ANY WARRANTY, EXPRESS OR IMPLIED, RELATIVE TO ANY MANAGEHUB METHODS, PRODUCTS, OR SERVICES, INCLUDING THE ADVISORY REFERENCED ABOVE. MANAGEHUB AND THE MANAGEHUB’S ADVISORS EXPRESSLY EXCLUDE ANY AND ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

MANAGEHUB AND THE MANAGEHUB’S ADVISORS WILL HAVE NO LIABILITY WITH RESPECT TO OBLIGATIONS UNDER THIS AGREEMENT FOR CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR INCIDENTAL DAMAGES, EVEN IF THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY CASE, MANAGEHUB’S LIABILITY, AND THE LIABILITY OF THE MANAGEHUB’S ADVISORS, INCLUDING LIABILITY ARISING OUT OF CONTRACT, NEGLIGENCE, AND STRICT LIABILITY IN TORT OR WARRANTY, WILL NOT EXCEED ANY AMOUNTS PAYABLE BY CLIENT FOR THE PROVIDER SERVICES IN QUESTION.
All advisory and support services are provided via phone, email, online collaboration tools or online collaboration features included in software.

Severability

In the event of invalidity of any provision of this license, the parties agree that such invalidity shall not affect the validity of the remaining portions of this license.

Acknowledgment

By using any of the ManageHub Methods or Services provided by ManageHub or Advisors, you and your Organization acknowledge that you have read and understand the foregoing and that you agree to be bound by its terms and conditions. You also agree that this agreement is the complete and exclusive statement of the agreement between the parties and supersedes all proposed or prior agreements, oral or written, and any other communications between the parties relating to the license described herein. Furthermore, you acknowledge that this agreement can only be modified by a written agreement.
